Terms and Conditions
Last updated: 27 January 2026
These Terms and Conditions (Terms) govern your access to and use of the Hurtle platform, website, and related services (Services). Hurtle (“Hurtle”, “we”, “us”, “our”) is a private rental matching service connecting prospective renters, real estate agents, landlords, and related participants.
By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.
1. Eligibility and Account Use
- You must be at least 18 years old and legally capable of entering binding contracts under Australian law.
- You must provide accurate, current, and complete information when creating an account and keep your information updated.
- You are responsible for all activity that occurs under your account credentials.
- You must keep your login details secure and notify us immediately of any unauthorised access.
2. Nature of Services
- Hurtle provides a private matching and pre-screening platform and does not act as a real estate agent, lessor, property manager, financial adviser, insurer, or legal adviser.
- We do not guarantee that any user will receive a rental offer, secure a tenancy, or achieve any specific outcome.
- Any lease or tenancy agreement is solely between the relevant renter, landlord, and/or agent, and not with Hurtle.
- We may refuse, pause, or remove access to the Services where required for quality control, risk management, legal compliance, or operational reasons.
3. User Representations
You represent and warrant that:
- information and documents you provide are true, complete, and not misleading;
- you have all rights and authority necessary to provide that information and documentation;
- your use of the Services will comply with all applicable laws, including tenancy, privacy, anti-discrimination, and consumer protection laws in Australia.
4. Verification and Background Checks
You authorise Hurtle to conduct or arrange identity, eligibility, and profile verification checks (including through third-party providers) to support trust, safety, and platform integrity.
You must cooperate with reasonable requests for additional information to complete verification and maintain access.
5. Fees and Payments
- Where fees apply, they will be disclosed before payment is required.
- Unless otherwise stated, fees are in Australian dollars and are non-refundable except where required by law.
- You authorise us and our payment processors to charge applicable amounts using your selected payment method.
6. Acceptable Use
You must not:
- use the Services for unlawful, fraudulent, misleading, or abusive purposes;
- submit false applications, fabricated references, or altered documents;
- interfere with platform security, attempt unauthorised access, or reverse engineer the Services;
- scrape, harvest, or extract data from the Services without our prior written consent;
- use the Services in a way that infringes any person's rights, including privacy, intellectual property, or confidentiality rights.
7. Suspension and Termination
We may suspend or terminate your account immediately if we reasonably believe you have breached these Terms, created a material risk to users or us, provided false information, or where required by law.
You may stop using the Services at any time. Termination does not affect rights and obligations accrued before termination.
8. Intellectual Property
- We own or license all rights, title, and interest in the Services, including software, design, branding, and content, excluding user content.
- Subject to your compliance with these Terms, we grant you a limited, non-exclusive, revocable, non-transferable licence to access and use the Services for their intended purpose.
- You grant us a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, and communicate your submitted content as reasonably required to operate and improve the Services.
9. Privacy
Our collection, use, and disclosure of personal information is governed by our Privacy Policy, available at /privacy, which forms part of these Terms.
10. Third-Party Services
The Services may include links to or integrations with third-party products or services. We are not responsible for third-party services, and your use of them is subject to their own terms.
11. Availability and Service Changes
We may modify, update, suspend, or discontinue any part of the Services at any time, including introducing or changing features and eligibility criteria.
We do not guarantee uninterrupted or error-free operation, though we will take reasonable steps to maintain service continuity.
12. Warranties and Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL), or any other law that cannot be excluded.
To the maximum extent permitted by law, and subject to non-excludable rights, the Services are provided on an “as is” and “as available” basis, and we disclaim all other warranties not expressly stated in these Terms.
13. Limitation of Liability
To the maximum extent permitted by law, and subject to any non-excludable rights, Hurtle's aggregate liability arising out of or in connection with the Services or these Terms is limited to the greater of:
- the amount you paid us for Services in the 12 months prior; or
- AUD $100.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, exemplary, or consequential loss, including loss of profits, opportunity, reputation, or data.
14. Indemnity
You indemnify and hold harmless Hurtle, its officers, employees, and contractors against claims, losses, liabilities, damages, and costs (including reasonable legal costs) arising from your breach of these Terms, misuse of the Services, or violation of law or third-party rights, except to the extent caused by our negligence, fraud, or wilful misconduct.
15. Dispute Resolution
If a dispute arises, the parties must first attempt to resolve it in good faith by written notice and genuine negotiation for at least 30 days before commencing court proceedings, except for urgent injunctive or declaratory relief.
16. Governing Law and Jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia in relation to any dispute arising out of or in connection with these Terms or the Services.
17. Changes to Terms
We may amend these Terms from time to time. Updated Terms will be published on this page with a revised “Last updated” date. Continued use of the Services after changes are published constitutes acceptance of the updated Terms.
18. Severability and Entire Agreement
If any provision of these Terms is held invalid or unenforceable, that provision will be severed to the extent necessary and the remaining provisions continue in full force and effect.
These Terms, together with the Privacy Policy and any additional terms expressly incorporated, constitute the entire agreement between you and Hurtle concerning the Services.
